On the official web portal of the Parliament of Ukraine, a new law 3065-IX was published on June 8, which makes amendments to the legislation regarding how notarization and registration actions take place when acquiring rights to land plots.

What the law is about

This law establishes that the verification of compliance of agricultural land with the requirements set by the Land Code of Ukraine shall not be conducted when acquiring ownership of agricultural land plots:

  • for gardening on an area not exceeding 0.25 hectares;
  • for the conduct of a personal peasant farm with an area of up to 2 hectares, located within the boundaries of populated areas.

Before concluding the contract for the transfer of ownership rights to the specified land plots, their new owner must confirm that the requirements established by the Land Code of Ukraine have been met. For this, it is necessary to contact a notary who will certify the document confirming the corresponding application.

Registration of land plots under the new law

The law states that when calculating the total area of agricultural land plots that are jointly owned by spouses, only the area registered in the name of the owner specified in the property rights is taken into account.

The document enhances the efficiency of the transfer of the preemptive right to purchase agricultural land plots by limiting its duration, while previously this process was indefinite. In addition, the number of persons prohibited from acquiring ownership of such plots has been increased, including participants and ultimate beneficial owners of legal entities under sanctions. It has also been established that the state registration of property rights to an agricultural land plot and the termination of lease rights occur simultaneously with the termination of the preemptive right to purchase this plot, registered in the State Register of Rights, without the need for a corresponding application.

How it was before

Previously, the procedure for acquiring property rights to agricultural land plots was quite complicated. The notary would conduct a check on the acquirer of such rights against numerous legal requirements that were imposed on the owner of such plots.

Typically, the process took about one or two weeks and resulted in an increase in notary service costs.
