Every adult Ukrainian has the right to receive land from the state for free. This is stipulated in the Land Code of Ukraine (LCU).

To become the owner of land, certain actions must be taken. Be patient, as obtaining a plot of land in Ukraine is not a quick matter. However, by systematically following the points of the plan, you will acquire a share.

Acquisition of land in Ukraine

Sizes of the plot

According to Article 121 of the LAND CODE OF UKRAINE, the size of the plot depends on how you intend to use the territory. The largest area allocated to you depends on what you need it for:

  • farmstead — determined by the rural, settlement, or city council;
  • agricultural farm up to 2 ha;
  • gardening – 0.12 ha;
  • cottage – 0.1 ha;
  • the construction of a residential building in the village – 0.25 hectares;
  • to the village – 0.15 ha;
  • city – 0.1 ha;
  • the construction of a garage – 0.01 ha.

It follows that every adult Ukrainian has the right to receive 6 shares for free, provided that they are of different purposes. The presence of plots in relatives does not matter at all.

Search for land plot

You need to search for land free of claims independently. The finding of a plot is not tied to your registration and can be located in another region. For this, it is convenient to use the public cadastre map. After registering on the service, you will easily search for a land plot.

Filing an application

Information to be included in the request:

  • for what purpose are you requesting the land;
  • approximately its area;
  • graphic image showing the location of the solder joints.

The application for obtaining a land plot must include a printed fragment of the cadastral map. The location of the plot is marked on it with a pen or a marker.

Submit an application

Depending on the intended purpose of the lands, the request is sent to different organizations:

  • For communal property located in the populated area, rural, settlement, and local councils are responsible;
  • land outside populated areas — district state administrations;
  • land for peasant farming and horticulture outside of populated areas — Main Department of State Geocadastre of the region.

The application is prepared in two copies and is sent by registered mail with a receipt. However, you can submit the application in person by delivering it to the address of the known organization. One copy with a wet stamp remains with you.

The application will be considered within 30 days.

Appeal to the land user

It is necessary to provide a land management project. Its development is handled by a design organization. However, you will have to pay for this procedure. The cost of contacting a land surveyor depends on the company you place the order with.

Transfer of the project to the State Ge cadastre

Depending on the situation, the transfer of the project to the State Geocadastre is carried out by you, or with prior agreement, by the design organization.

Approval of the original project

After approval from the State GeoCadastre, the documents are submitted to the local government. A notification is included with a request to approve the original project.

After this procedure, the territorial authority carries out the free transfer of the land plot from state ownership to the ownership of a citizen of Ukraine. You receive the cadastral number of the plot and documents that confirm its location and area.

Registration of the plot in the State Register

The final stage is the registration of the plot in the State Register of Real Estate Rights. For this, one should contact the CPAU and a lawyer.

You should have with you:

  • extract from the State Land Cadastre;
  • the receipt for the payment of the administrative commission;
  • originals and copies of documents confirming identity (passport and TIN);
  • application for registration of rights, the sample will be provided by the lawyer.

If the documents are submitted by a representative of an individual, a notarized power of attorney and a copy of the original passport, as well as the representative’s tax identification number (TIN), will also be required.

Within 5 working days, the state registrar will review the materials you provided and make a decision.
