The legislation of Ukraine guarantees every citizen the right to receive a land plot for free. However, the area of such plots may vary depending on their purpose and location.
What sizes of land can be obtained?
According to Article 121 of the Land Code of Ukraine, every citizen has the right to receive up to 2.5 hectares of land from state or communal ownership. The sizes of the plots depend on the settlement where the land is located:
- 2.48 ha — for rural areas;
- 2.38 ha — in the settlements;
- 2.33 ha — in cities.

These indicators are the maximum allowable and include different types of land intended for various purposes.
What types of land can be obtained?
According to the Land Code, every citizen has the right to obtain a land plot for the following purposes:
- engagement in personal peasant farm. For this type of activity, it is possible to obtain the largest area – up to 2.0 hectares;
- horticulture. The land plots can be used for planting gardens, with a maximum area of up to 0.12 hectares;
- construction and maintenance of housing. Land can be obtained for the construction of a residential building: in villages – up to 0.25 hectares, in towns – up to 0.15 hectares, in cities – up to 0.10 hectares;
- individual cottage construction. The plot for the cottage can be allocated with a size of up to 0.10 hectares;
- Construction of garages. For the construction of individual garages, it is possible to obtain land with an area of up to 0.01 hectares.
Is it possible to obtain land now?
Currently, due to martial law, the process of privatization of land plots is temporarily suspended. However, some categories of citizens can still exercise their right to privatization:
- the presence of private ownership on the site. If there is already private real estate located on the land plot that was previously transferred for use, its owners have the right to privatization;
- if the land was transferred for use before 2001. Citizens who received land for use before 2001 retain the possibility of privatizing this land.
Conclusion
Although every Ukrainian has the right to free privatization of land according to the Land Code, this right is restricted during martial law. Only those citizens who meet certain conditions can privatize land plots.
