After all, it was then that draft law 2178-10 was finally adopted. This document introduces the land market. The decision was supported by 259 MPs. But this is only the beginning. In the near future, the Verkhovna Rada will have to consider a number of documents from the &#8220;land package&#8221;. These documents will provide more details on the regulation of relations between land market participants.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img loading=\"lazy\" decoding=\"async\" width=\"500\" height=\"226\" src=\"https:\/\/zemi.com.ua\/wp-content\/uploads\/2021\/03\/zakon-pro-zemlyu-na-poryadku-dennomu.jpg\" alt=\"sale of agricultural land\" class=\"wp-image-28\" srcset=\"https:\/\/zemi.com.ua\/wp-content\/uploads\/2021\/03\/zakon-pro-zemlyu-na-poryadku-dennomu.jpg 500w, https:\/\/zemi.com.ua\/wp-content\/uploads\/2021\/03\/zakon-pro-zemlyu-na-poryadku-dennomu-300x136.jpg 300w\" sizes=\"auto, (max-width: 500px) 100vw, 500px\" \/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Land law: main provisions<\/h2>\n\n\n\n<p>The population of our country has been waiting for the approval of the scandalous draft law for a long time. The document was constantly surrounded by rumors. However, everything turned out to be not so complicated and bad. To confirm this, let&#8217;s look at the main provisions of the land law:<\/p>\n\n\n\n<ol class=\"wp-block-list\"><li>Lifting the moratorium on the sale of agricultural land. The decision will come into force on July 1, 2021.<\/li><li>Restrictions on the purchase of land plots. From 1.07.2021 to 1.01.2024, no more than 100 hectares per 1 owner will be allowed to be purchased. Starting January 2, 2024, the restriction will be somewhat eased: up to 10,000 hectares per person. This is what was envisaged in the first version of the draft law. However, the conditions were changed to prevent abuse.<\/li><li>Legal entities cannot buy agricultural land. This restriction will be in effect from July 1, 2021, to January 1, 2024. This will ensure transparent competition.<\/li><li>Hold a referendum on granting the right to purchase land to foreigners. Without this, the issue will not be resolved.<\/li><li>Moratorium on land sales to foreigners. Even if the referendum allows such transactions, citizens of other countries will not be able to buy land located within 50 km of the state border.<\/li><li>Additional restrictions. Starting in 2024, citizens of the Russian Federation who are members of terrorist groups will not be able to purchase land. The purchase ban also applies to organizations owned by foreign states, offshore companies, or beneficiaries whose identity cannot be established. Legal entities from countries that do not cooperate with Ukraine in combating money laundering will not be allowed to purchase agricultural land. Companies that are subject to sanctions will also not be able to purchase land.<\/li><li>The lessee has a preemptive right to purchase the land. A person who has been leasing land and working on it under the right of use no later than 2010 has the right to buy the land without bidding in installments for up to 10 years. The value of the land plot will be equal to the normative monetary value of such land. In this case, ownership of the land will be transferred to the buyer upon making the first payment. The lessee may also transfer the right to purchase the land to another person by notifying the landowner in writing.<\/li><li>Transfer of land to the ownership of banks. This situation is possible, provided that the land was used as collateral for an outstanding loan. However, the bank will not be able to own the land on a permanent basis. The institution will have to sell the land at a land auction within 2 years from the date of acquisition of ownership.<\/li><li>Minimum price control. The price must not be less than the normative monetary value. The restriction will be in effect until 2030.<\/li><li>Prohibition on the sale of state-owned or municipally owned land.<\/li><\/ol>\n\n\n\n<p>These restrictions will come into force soon.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Next steps in land reform<\/h2>\n\n\n\n<p>Over time, other legislative initiatives will become relevant. Among them are the following draft laws:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>\u21160858. It has already been signed and approved by the President. This is not surprising, as the document is called an anti-raider bill. It will automate the exchange of information between the registry of rights and the land cadastre. The document also stipulates mandatory digitization of information on paper and its entry into the electronic registry of rights. The document also provides for the registration of the value of land transactions.<\/li><li>\u21162195. The draft law was adopted in the first reading. It introduces transparent electronic land auctions. State-owned and municipally owned land can be sold and purchased only through such open auctions.<\/li><li>\u21162194. The draft law, which is called deregulation, was adopted in the first reading. It simplifies the process of transferring land plots. It also provides for the decentralization of land management. That is, state-owned land outside settlements will be transferred to the communal ownership of communities. Further control, which is currently exercised by the State Cadastre, will be transferred to specialized local authorities.<\/li><\/ul>\n\n\n\n<p>A number of reforms will help make transactions with agricultural land as simple and transparent as possible.
